These Digital Product Terms & Conditions (“Digital Terms”) apply to all digital products purchased through www.mothermotherdoula.com (the “Site”) and form part of the general Terms & Conditions. By purchasing or accessing a digital product, you agree to these Digital Terms in full.
1. Types of Digital Products
Mother Mother Doula offers digital products in two categories:

- Personal-Use Digital Products – guides, cheat sheets, fact sheets, templates, courses, and app-based resources.

- Commercial-Use Digital Products – products sold specifically for business use, such as the Digital Back-Up Doula Agreement.
The product description will specify which category applies.
2. Personal-Use Digital Products
Unless specifically identified as a commercial-use product, all digital products are for personal use only.

- You are granted a non-exclusive, non-transferable licence for personal purposes.

- You may not share, resell, distribute, or make these products available to others, whether free or paid.

- You may store one copy for backup purposes provided it remains accessible only to you.
3. Commercial-Use Digital Products
Where a product is sold with a commercial-use licence, additional permissions apply.

- You are granted a non-exclusive, perpetual licence to:
• Edit, adapt, and customise the template for your own business.
• Use the product internally within your business operations (e.g. providing it to your paying clients).

- You may not:
• Resell, sublicense, or distribute the original template to other businesses.
• Market or sell the product as a standalone item in competition with Mother Mother Doula.
Specific Caveat – Digital Back-Up Doula Agreement

- This agreement is sold as a template only and does not constitute legal advice.

- You are responsible for ensuring the contract meets the requirements of your own jurisdiction.

- Independent legal review is strongly recommended before using the agreement in your business.
4. Payment & Delivery

- Full payment is required before access is granted.
-
- Access is generally provided immediately after purchase. In some cases (manual processing or technical issues), access may take up to 48 hours.

- You are responsible for ensuring your device and software can access the product (e.g. PDF reader, Word processor, internet connection).
5. Refunds & Faulty Files

- All digital product sales are final and non-refundable. This includes both personal-use and commercial-use products.

- Under the Australian Consumer Law (ACL), you are entitled to a remedy if a product is faulty.

- If a file is corrupted, inaccessible, or otherwise faulty, you must notify us within 7 days of purchase. A replacement file will be provided at no additional cost.

- Refunds will not be offered for change of mind, accidental purchase, or failure to use the product.
6. Updates & Revisions

- Digital products are accurate and current at the time of publication.

- From time to time, updates may be released. Purchase of a product does not entitle you to all future updates free of charge unless explicitly stated in the product description.

- Major revisions or new editions may be offered at a discounted rate for existing purchasers at our discretion.
7. Intellectual Property

- All intellectual property rights remain the property of Mother Co Pty Ltd.

- For personal-use products, purchase provides a personal licence only.

- For commercial-use products, purchase provides an internal business licence as outlined above.

- Copyright is not transferred upon purchase.
8. Disclaimer & Limitation of Liability

- Digital products are provided for educational and informational purposes only.

- They are not a substitute for medical, clinical, or legal advice.

- You are responsible for how you apply the information. Always consult a qualified professional where appropriate.

- The Digital Back-Up Doula Agreement is provided as a template and should be reviewed by a lawyer before use.

- To the maximum extent permitted by law, our liability is limited to the purchase price of the product.
9. Consumer Protection
Nothing in these Digital Terms excludes or limits rights under the Australian Consumer Law. Where a consumer guarantee applies, you are entitled to a remedy as provided by law.
10. Termination of Licence

- We reserve the right to revoke your licence if these terms are breached.

- For personal-use products: you must cease use and delete all copies.

- For commercial-use products: you may continue to use documents already integrated into your business with existing clients, but redistribution must cease immediately.
11. Governing Law & Disputes

- These Digital Terms are governed by the laws of Western Australia.

- In the event of a dispute, both parties agree to attempt resolution through direct communication.

- If unresolved, the matter may be referred to mediation. Costs are to be shared equally unless otherwise agreed.

- If mediation fails, disputes will be heard in the courts of Western Australia.
12. Changes to Terms
We may amend these Digital Terms at any time. Updates will be posted on this Site with the “Last Update
