These Terms & Conditions (“Terms”) govern your access to and use of www.mothermotherdoula.com (the “Site”) and all products, content and services offered by Mother Co Pty Ltd trading as Mother Mother Doula (“we”, “us”, “our”). These Terms apply in addition to any specific contract, service agreement, product-specific conditions, hire terms, refund policy, privacy policy, booking terms or waiver that may apply to a particular product or service. If there is any inconsistency, the more specific document will apply to the extent of that inconsistency.

1. Website Use

You agree to use this Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit the use and enjoyment of the Site by any other person.

You must not:

  • misuse this Site or attempt to interfere with its operation, security or availability

  • attempt to gain unauthorised access to any part of the Site, server, database or connected systems

  • copy, scrape, reproduce, distribute or exploit Site content without permission

  • use this Site in any way that is unlawful, fraudulent, misleading, defamatory, abusive or harmful

  • upload or transmit viruses, malware, malicious code or harmful content

  • place false, speculative or fraudulent orders

We reserve the right to suspend, restrict or terminate access to the Site or any account where we reasonably believe these Terms have been breached.

2. Eligibility and Accuracy of Information

You must ensure that any information you provide to us is accurate, current and complete, including your name, address, contact details, due date, payment details and any other information relevant to your order, booking or account.

You are responsible for ensuring that the products, services or resources you purchase are suitable for your needs before placing your order.

3. Intellectual Property

All content on this Site, including but not limited to text, wording, photographs, images, product designs, branding, logos, graphics, course materials, videos, downloads, PDFs, guides, templates, resources, handouts, educational materials, digital files and client galleries, is the property of Mother Co Pty Ltd unless otherwise stated and is protected by applicable intellectual property laws.

You may not reproduce, copy, alter, adapt, publish, upload, distribute, resell, sublicense, create derivative works from, or otherwise exploit our content without our prior written permission.

Client photographs remain the intellectual property of Mother Co Pty Ltd. Clients are granted a personal, non-exclusive, revocable, non-transferable licence to use their images for personal purposes only, including printing, storing and sharing with friends or family on personal social media. Images must not be sold, licensed, edited beyond basic cropping or print preparation, used for business or commercial purposes, submitted to third parties, or supplied to vendors, publications or other businesses without our express written permission.

With client consent, images may be used by us for portfolio, promotional, educational or business purposes. Consent may be withdrawn at any time by contacting us in writing, but withdrawal will not apply retrospectively to material already printed, published, distributed or otherwise used before we received your notice.

4. Accounts

When creating an account, you agree to:

  • provide accurate, current and complete information

  • keep your login details secure and confidential

  • update your details if they change

  • accept responsibility for all activity that occurs under your account

We are not liable for unauthorised use of your account where you have failed to maintain the confidentiality or security of your login details. We reserve the right to suspend or terminate accounts that are misused, contain false information, are associated with suspicious activity, or are otherwise in breach of these Terms.

We reserve the right to correct errors, update listings, withdraw products or services, change pricing, limit quantities, cancel orders, or refuse service at our discretion, including where a product has been listed with incorrect information or pricing.

6. Orders, Acceptance and Availability

Placing an order through the Site does not guarantee acceptance. An order is only accepted once payment has been received and we have confirmed or begun processing the order.

We reserve the right to reject, cancel or limit any order, including where:

  • stock is unavailable

  • there is a pricing or listing error

  • payment cannot be verified or processed

  • the order appears fraudulent, suspicious or unauthorised

  • shipping is not available to the address provided

  • we reasonably believe the order breaches these Terms

If we cancel an order after payment has been received, we will provide an appropriate refund in accordance with applicable law and our policies.

If a product or service paid for cannot be supplied on time or within a reasonable time, consumer rights may apply under the ACL. Online purchases from a business also carry the usual consumer rights and guarantees that cannot be excluded.

7. Pricing and Payments

We accept payment via:

  • Stripe

  • PayPal

  • Direct Bank Transfer

All prices are displayed in Australian dollars unless otherwise stated.

Prepayment is required for all store and hire purchases. Doula and birth photography clients must have fees paid in full by 35 weeks of pregnancy unless otherwise agreed in writing. Photography clients may prepay or request a payment plan. Payment plans are offered at our discretion and, once agreed, must be adhered to strictly.

We reserve the right to change prices at any time without notice, provided such changes will not affect orders already accepted.

Late Payment

Invoices not settled by the due date may incur additional fees. We reserve the right to suspend services, cancel bookings, pause editing, withhold delivery of services, products, downloads or images, refuse future bookings, or take recovery action until full payment is received.

Any bank fees, chargeback costs, debt recovery fees, administrative costs or other reasonable enforcement costs incurred by us as a result of non-payment, failed payment, reversed payment or chargeback may be recoverable from you to the extent permitted by law.

8. Shipping, Delivery and Risk

For physical products, we will use reasonable efforts to dispatch within the timeframe stated on the Site or otherwise advised. Dispatch and delivery timeframes are estimates only and are not guaranteed unless expressly stated.

We are not liable for courier delays, postal disruptions, incorrect delivery information provided by you, lost parcels after confirmed delivery, customs delays, acts of third parties or events outside our control.

Risk in physical goods passes to you upon delivery to the address provided in your order, or upon collection if local pickup is offered.

You are responsible for ensuring your delivery address is correct. Additional shipping or re-delivery charges may apply where parcels are returned, unclaimed, redirected or require re-sending due to incorrect information supplied by you.

Title in goods does not pass until full payment has cleared.

9. Refunds and Cancellations

Refunds, exchanges, returns and cancellations are managed in accordance with our Refund & Cancellation Policy and any product-specific or service-specific cancellation terms. If there is any inconsistency between these Terms and the Refund & Cancellation Policy, the Refund & Cancellation Policy will apply to the extent of that inconsistency.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or other non-excludable laws. Consumer guarantees apply to products and services supplied by businesses and cannot be contracted out of.

10. Hire Items

Hire items are governed by their own Hire Terms & Conditions. By hiring an item, you agree to those terms in full, including any applicable collection, return, late fee, damage, cleaning, replacement cost and bond requirements.

Relevant hire pages may include, without limitation:

  • Birth Sling Hire Terms & Conditions
  • TENS Hire Terms & Conditions
  • Birth Pool Hire Terms & Conditions
  • Wardrobe Hire Terms & Conditions

Hire items may require a refundable bond, as set out in the relevant Hire Terms & Conditions. Any bond refund is subject to the item being returned on time, in the required condition, and otherwise in accordance with the applicable hire terms.

11. Client Images and Photography Limitations

Images of clients are created, stored and shared with consent, which may be verbal or written unless otherwise required by a separate service agreement. Clients may withdraw consent at any time by contacting us in writing, subject to the limitations stated in these Terms and any separate photography contract.

Images are provided for personal use only and may not be sold, altered, licensed, commercially exploited, or used by third parties without our prior written consent.

We are not liable for circumstances outside our control that may affect photography outcomes, including but not limited to poor weather, lighting conditions, location restrictions, venue rules, restricted access, emergency changes, uncooperative children, uncooperative adults, birth circumstances, missed moments, equipment failure despite reasonable precautions, health issues, or other factors beyond our reasonable control.

We do not guarantee specific images, poses, moments, gallery size, editing style preferences beyond our portfolio, cooperation of participants, or outcomes affected by the surrounding environment.

12. Doula Support Limitations

As a doula, Sarah Del Borrello provides emotional, physical and educational support. She does not provide medical care, undertake clinical assessments, diagnose conditions, prescribe treatment, make clinical decisions, or act as a substitute for a midwife, obstetrician, GP, nurse, allied health professional or any other qualified healthcare provider.

To work with us, clients must be under the care of, and continue to receive care from, an appropriate maternity care provider throughout pregnancy and birth.

Any information, discussion, suggestions, resources or advocacy support we provide are intended to support informed decision-making only. Final responsibility for all decisions regarding pregnancy, labour, birth, postpartum care and newborn care remains with the client and their healthcare provider.

We do not guarantee any specific birth outcome, labour pattern, intervention rate, breastfeeding outcome, postpartum outcome, or emotional experience.

13. Educational Content and General Information Disclaimer

All educational and informational content supplied by us, whether on the Site, in a product listing, by email, in a download, in a handout, in an affirmation card deck, in a guide, in a fact sheet, in a template, in a course, during support services, or otherwise, is provided for general educational and informational purposes only.

This content:

  • is not medical advice

  • is not clinical advice

  • is not diagnostic advice

  • is not mental health advice

  • is not legal, financial or professional advice

  • is not a substitute for individual advice from an appropriately qualified professional

While we aim to provide thoughtful, evidence-aware and accurate resources, pregnancy, birth, postpartum care, newborn care, breastfeeding, product safety guidance, aromatherapy information, research evidence, professional recommendations, regulations and clinical guidelines can change over time. For that reason:

  • our content may not always reflect the most recent research, guidance, standards or clinical recommendations

  • our content may be general in nature and may not be appropriate for your individual circumstances

  • we do not warrant that educational materials will be complete, current, clinically appropriate, error-free or suitable for any specific purpose

By using our educational content, you acknowledge that you are responsible for assessing whether it is appropriate for your situation and for seeking individual advice from a qualified healthcare provider or other professional where needed.

You agree that you will not rely solely on our resources, downloads, handouts, affirmations, checklists, templates, articles or educational content when making medical, clinical, mental health, safety or other significant decisions.

14. Digital Products and Online Resources

All digital sales are final except where a remedy is required under the Australian Consumer Law.

Digital products, online resources and downloadable content include, without limitation:

  • printable affirmation cards

  • PDFs

  • handouts

  • fact sheets

  • cheat sheets

  • templates

  • workbooks

  • guides

  • e-books

  • digital classes or courses

  • future online memberships, portals or app-based content

  • audio, video or mixed-media resources

  • bonus downloads supplied with a purchase

14.1 Licence and Permitted Use

Unless otherwise expressly stated, all digital products are licensed, not sold, to the original purchaser only. The licence granted is personal, non-exclusive, non-transferable, revocable and for personal use only.

You may:

  • download the files to your own devices

  • print copies for your own personal use

  • store backup copies for your own access

You may not:

  • share, forward, gift, email or otherwise distribute files to another person

  • upload files to social media, cloud sharing services, marketplaces, forums, membership sites, AI training datasets, public repositories or third-party platforms for others to access

  • reproduce, copy, resell, sublicense, commercially exploit or white-label the content

  • edit, remove branding from, extract content from, or repurpose the files for resale, teaching, client delivery, business use or publication

  • claim the content as your own

  • use our files or content in whole or in part to create competing products, resources, templates or downloads

14.2 Digital Delivery and Access

Digital products are generally made available by download link, checkout confirmation page, email delivery, account access or another delivery method selected by us.

You are responsible for:

  • providing a correct email address

  • checking spam or junk folders

  • downloading and saving your purchase promptly

  • ensuring you have compatible software, hardware, internet access, storage and printing capability where relevant

We are not liable for download or access issues caused by:

  • your device, browser, internet connection or software

  • third-party platform outages

  • email filtering

  • firewall restrictions

  • expired links where files were not downloaded within a reasonable period

  • your failure to save the files after purchase

Where a digital file is corrupted, inaccessible or materially defective due to our error, we may, at our discretion and subject to your ACL rights, reissue the file, provide a replacement file, or provide another appropriate remedy.

14.3 Printing, Display and Colour Variation

Printable products are supplied in the format stated in the product listing. You are responsible for choosing suitable paper, card, print quality, printer settings, trim and finishing.

We do not guarantee specific print results, colours, margins, sharpness or material performance across all printers, papers or third-party print providers. Colour, scale and layout can vary depending on your screen, printer, software and settings.

14.4 Educational and Informational Nature of Digital Products

Many digital products sold on this Site are educational, reflective or supportive resources only. They are not a substitute for personalised professional advice, clinical care, diagnosis, treatment or therapy.

Affirmation cards, handouts, fact sheets and similar resources are intended to offer general support, education or reflection only. They do not create a practitioner-client relationship beyond the scope of any separately booked service, and they do not create any guarantee of outcome.

14.5 Future Updates and Versioning

Unless expressly stated in the product listing, purchase of a digital product entitles you only to the version available at the time of purchase. We are under no obligation to provide future updates, revised editions, replacement versions, expanded content or ongoing access.

We may update, discontinue, replace or remove digital products at any time without notice.

14.6 Personal Use and Copyright Enforcement

Unauthorised sharing or distribution of our digital products causes direct commercial harm. We reserve the right to:

  • revoke access

  • refuse future sales

  • request takedown of infringing copies

  • pursue recovery for losses

  • take legal action or other enforcement steps where misuse is identified

15. Physical Retail Products and Product-Specific Limitations

This section applies to physical goods sold through the Site, including but not limited to aromatherapy rollers, massage oils, aromatherapy mists, birth combs, affirmation cards, tools, accessories, gift products and similar items.

15.1 General Product Use

You are responsible for reading and following all product descriptions, instructions, warnings, ingredients, labels and care information supplied with a product or on the Site.

Products must only be used:

  • for their intended purpose

  • in accordance with any instructions provided

  • by persons for whom they are suitable

We are not liable for misuse, overuse, unintended use, failure to follow directions, failure to patch test where appropriate, failure to supervise children, failure to check ingredients, or continued use after irritation, damage or fault becomes apparent.

15.2 Aromatherapy, Oils, Mists and Topical Products

Where we sell aromatherapy rollers, massage oils, mists or similar topical products:

  • they are provided for external use only unless expressly stated otherwise

  • you are responsible for reviewing ingredients before purchase and use

  • you are responsible for assessing suitability for yourself, including allergy, irritation, sensitivity, skin condition, pregnancy considerations or other personal circumstances

  • patch testing is recommended before first use where appropriate

  • use must cease if irritation, discomfort or adverse reaction occurs

  • such products are not medical treatment and are not intended to diagnose, treat, cure or prevent any disease or condition

To the maximum extent permitted by law, we are not liable for reactions, sensitivities, allergies, misuse or use contrary to instructions.

15.3 Birth Combs and Similar Tools

Where we sell birth combs or other comfort tools:

  • you are responsible for using them safely and as intended

  • you must inspect the product before use and stop use if it is damaged, cracked, splintered, faulty or otherwise unsuitable

  • these products are support tools only and do not guarantee pain relief, labour progress or any birth outcome

15.4 Product Presentation and Natural Variation

Where products contain natural ingredients, handmade elements, wood, fabric, glass, packaging or other natural or variable components, slight differences in colour, grain, scent, texture, consistency, fill level, batch appearance, packaging or finish may occur and will not be treated as a defect where the product remains of acceptable quality.

15.5 Safety and Supervision

Some products may present hazards if misused, damaged or used around babies or children. You are responsible for safe storage, safe handling and appropriate supervision. Products should be kept out of reach of children unless expressly designed for child use and used with proper supervision.

Current product safety obligations and consumer guarantees cannot be excluded, and businesses must still supply goods that meet applicable consumer rights and safety requirements.

16. Gift Vouchers and Promotions

Gift vouchers are valid for three years from the date of purchase unless a longer period is required by law and are non-refundable except where required by law.

Promotions, discounts, bundles, bonus offers and codes:

  • cannot be combined unless explicitly stated

  • are subject to availability and expiry

  • may be varied or withdrawn at any time

  • must not be shared, published or distributed outside authorised Mother Mother Doula communications unless expressly permitted

We reserve the right to cancel, refuse or reverse a discount, voucher, bonus offer or promotional benefit where we reasonably believe it has been misused, obtained fraudulently, published without permission, exploited contrary to its intended purpose, or applied in breach of these Terms.

17. Privacy and Data

Your use of this Site is also governed by our Privacy Policy, which explains how we collect, use, disclose and protect your personal information.

You acknowledge that internet transmissions are never completely secure. While we take reasonable steps to protect information, we do not guarantee absolute security of information transmitted to or from the Site.

18. Third-Party Platforms, Links and Tools

This Site may integrate with or link to third-party platforms, payment processors, email systems, booking systems, download systems, social media platforms, couriers, galleries or external websites.

We are not responsible for the availability, security, policies, functionality, acts or omissions of third-party providers. Your use of those services may also be subject to their own terms and policies.

19. Website Availability and Technical Issues

We do not guarantee that the Site, its functions, checkout, downloads, emails, booking tools or other features will be uninterrupted, timely, secure or error-free.

We may suspend, withdraw, modify or restrict the availability of all or any part of the Site for business, operational, maintenance, legal or security reasons without notice.

To the maximum extent permitted by law, we are not liable for losses arising from downtime, outages, technical errors, failed transmissions, malware, data corruption, server issues or other technical problems beyond our reasonable control.

20. Consumer Protection

Where the Australian Consumer Law or any other law implies a guarantee, warranty, right or remedy into these Terms which cannot lawfully be excluded, restricted or modified, those rights continue to apply.

Nothing in these Terms is intended to exclude, restrict or modify any non-excludable consumer guarantees, statutory warranties or other rights under applicable law. Businesses must meet consumer guarantees when selling products or services, and standard form terms must not be unfair. Since 9 November 2023, using or relying on unfair contract terms in consumer and certain small business standard form contracts has been prohibited and may attract penalties.

21. Liability and Indemnity

To the maximum extent permitted by law, our liability for any claim arising out of or in connection with the Site, any product, any digital product, any service, any booking, any download, any educational resource or any hire item is limited, at our option, to:

  • re-supplying the relevant service

  • replacing the relevant product or digital file

  • repairing the relevant product

  • paying the cost of re-supplying, replacing or repairing the relevant product or service

  • refunding the amount paid for the relevant product or service

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, exemplary or consequential loss or damage, including but not limited to:

  • loss of income

  • loss of opportunity

  • loss of profits

  • loss of business

  • emotional distress

  • disappointment

  • labour or birth outcomes

  • breastfeeding outcomes

  • postpartum outcomes

  • allergic reactions or sensitivities arising from misuse or failure to review ingredients

  • printing costs, third-party printing issues or device incompatibility

  • decisions made by you based on our content, products, services or resources

Without limiting the above, we are not liable for loss arising from:

  • reliance on general educational content

  • failure to seek professional or medical advice

  • your individual health circumstances

  • misuse of physical products

  • misuse or unauthorised sharing of digital products

  • third-party platforms, couriers or payment processors

  • events beyond our reasonable control

You agree to indemnify and hold harmless Mother Co Pty Ltd, its directors, officers, employees, contractors and agents from and against any claims, liabilities, losses, damages, costs or expenses, including reasonable legal costs, arising out of or connected with:

  • your breach of these Terms

  • your misuse of the Site

  • your misuse of any product, digital file, hire item or service

  • your infringement of our intellectual property rights

  • your breach of any law or the rights of any third party

This indemnity does not apply to the extent that a loss is caused by our negligence, fraud or wilful misconduct, or where such indemnity would be unenforceable by law.

22. Force Majeure

We are not liable for any delay, failure, interruption or inability to perform any obligation under these Terms where such delay or failure arises from events beyond our reasonable control, including but not limited to illness, injury, labour or birth attendance obligations, family emergency, natural disaster, fire, flood, pandemic, internet outage, supplier failure, courier disruption, power outage, government action or other force majeure events.

23. Dispute Resolution

If a dispute arises, both parties agree to first attempt to resolve the matter through direct communication in good faith.

If the dispute cannot be resolved informally, the matter may be referred to mediation before either party commences formal proceedings, except where urgent interlocutory relief is required.

Unless otherwise agreed or required by law, mediation costs are to be shared equally, or borne as determined by the mediator. If you want, I can revise this back to “borne by the client” to match your original position more closely, but equal sharing is usually less likely to look unfair in a standard form consumer contract.

24. Governing Law

These Terms are governed by the laws of Western Australia. Any dispute arising in connection with these Terms, the Site, or any product or service supplied by us is subject to the non-exclusive jurisdiction of the courts of Western Australia, except where applicable law requires otherwise.

25. Changes to Terms

We may update these Terms at any time to reflect changes in law, business practice, Site functionality, products, services or operational requirements.

The version published on the Site at the time of your use or purchase will apply unless otherwise required by law. Continued use of the Site after updated Terms are published constitutes acceptance of the revised Terms.

26. Severability

If any provision of these Terms is found to be invalid, void, unlawful or unenforceable, that provision is to be read down to the minimum extent necessary or, if that is not possible, severed, and the remaining provisions will continue in full force and effect.
